Registration rights are not granted for industrial designs, the use of which would be contrary to public policy or to good morals. The registration rights are also not granted for industrial designs containing indications which are not subject to monopolization. These marks include, but are not limited to:

• Name or abbreviation of the Polish Republic or its symbols (emblem, colour or hymn),
• Names or emblems of Polish provinces, cities or localities,
• Signs of the armed forces,
• Official or commonly used decorations and badges,
• Identification of social organisations acting in an important public interest
• Official identification, inspection and warranty stamps adopted in foreign countries
• Officially recognised markings, in particular safety signs, quality marks or legalization features
• Signs containing elements whose use could religious feelings, patriotic or national traditions.

The use of such names, symbols or designations, with the exception of patriotic, cultural and religious symbols, may be obtained by registration, subject to the proper authorisation of the competent authority by the notifier. The right of registration of an industrial design does not include the characteristics:

• Creation technical function;
• Which must be reproduced in exact form and dimensions in order to allow the mechanical connection or interaction with another product;
